About the session

Trust money is one of the few areas where a well-run practice can come unstuck on process rather than judgement. This session walks through where those mistakes actually happen, what the regulator looks for, and what to do if something has already gone wrong.

What the session covers

  • What is and is not trust money, and why it matters
  • Common errors and misconceptions: fixed fee billing, trust to office transfers, intermixing, third party recipients, records management and supervision
  • VLSB investigations and compliance audits
  • How to course correct

Who it is for

All lawyers, with or without trust authorisation.

About the speaker

Jennie Pakula is Director and Principal Lawyer of The Lawyer’s Friend, where she advises lawyers on regulatory compliance and practice risk. She spent three decades in legal profession regulation: an ethics adviser and complaint handler with the Law Society of NSW, then in Victoria conducting complaint investigations and prosecutions. From 2010 to 2018 she managed the team handling the bulk of complaints and enquiries at the VLSB+C, and she designed the first iteration of its compliance auditing program. Her final role there was Manager, Innovation and Consumer Engagement.
